Kyros Trials Website and Portal Terms of Use

The short version

  • These terms cover our public website, study prescreen pages and the participant portal. Research sites using Kyros Trials are covered by their own contract with us instead.
  • Nothing on these pages is medical advice. A prescreen can only tell you whether you may be a match for screening; only study staff decide who can take part.
  • Taking part in a study is always voluntary. You can stop a prescreen at any time.
  • The research site, not Kyros Trials, runs each study and is responsible for it.
  • In an emergency, call 911.
  • Your privacy is covered by our Privacy Policy and Consumer Health Data Privacy Policy.

1. Who these terms apply to

1.1 These Terms of Use ("Terms") govern your use of https://kyrostrials.com and related public pages, including study prescreen pages and the prescreen chat assistant (together, the "Public Pages"), and the participant portal (the "Portal"), operated by Bordano Tissue, LLC, doing business as Kyros Trials ("Kyros Trials," "we").

1.2 If you use Kyros Trials as an employee or contractor of a research site, or as an invited sponsor or CRO monitor, your use is governed by the agreement between that research site and Kyros Trials and by our Acceptable Use Policy. Sections 4, 6, 7 and 9–11 of these Terms also apply to you.

1.3 By using the Public Pages or Portal, you agree to these Terms. If you do not agree, do not use them.

2. Studies are run by research sites

Each study shown on a prescreen page or in the Portal is conducted by the research site named on the page (the "Research Site"), under the oversight of an Institutional Review Board. Kyros Trials provides software to the Research Site. Kyros Trials does not conduct studies, does not employ the study doctors, and does not decide who may take part. Questions about a study should go to the Research Site.

3. Not medical advice; prescreen results

3.1 Content on the Public Pages and Portal, including answers from the prescreen chat assistant, is for general information only and is not medical advice, diagnosis or treatment. Talk to your own doctor about your health and before making decisions about joining a study.

3.2 A prescreen result can only indicate that you may be a match for screening or do not appear to be a match based on your answers. It is not an eligibility decision. Only study staff decide whether you can be screened or enrolled, after an informed-consent process.

3.3 The prescreen chat is an automated assistant, not a person. You can contact a person at the Research Site at any time using the contact details shown on the page. See our AI Use Policy.

3.4 In an emergency, call 911. Do not use the Public Pages or Portal to report a medical emergency or an urgent side effect; contact the study team by phone as instructed in your consent form.

4. Eligibility and accounts

4.1 You must be at least 18 years old (or the age of majority where you live) to use the Public Pages or Portal yourself. A parent or legal guardian may complete a prescreen on behalf of a child for a pediatric study.

4.2 Portal accounts are created by invitation from a Research Site. Keep your login details confidential and tell the Research Site promptly if you believe someone else has used your account.

5. Voluntary participation

Completing a prescreen does not obligate you to take part in any study. Participation in research is voluntary, and you may withdraw at any time without penalty or loss of benefits to which you are otherwise entitled (21 CFR § 50.25(a)(8)).

6. Acceptable use

You agree not to: provide false information about someone else; access accounts or data that are not yours; interfere with, probe, scan or test the vulnerability of our systems (except under our responsible-disclosure program); use bots or scrapers; upload malicious code; or use the Public Pages or Portal in violation of law.

7. Intellectual property

Kyros Trials and its licensors own the Public Pages, Portal and their software, design and content, except content provided by Research Sites, which belongs to them. We grant you a limited, revocable, non-exclusive right to use them for their intended purpose.

8. Text messages and email

If you agree to receive text messages, our SMS Terms apply. Reply STOP to opt out at any time.

9. Disclaimers

THE PUBLIC PAGES AND PORTAL ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE EXTENT PERMITTED BY LAW, KYROS TRIALS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Nothing in these Terms limits any rights you have as a research participant under your informed-consent form or applicable law, and nothing waives any of your legal rights as a research participant (21 CFR § 50.20).

10. Limitation of liability

TO THE EXTENT PERMITTED BY LAW, KYROS TRIALS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE PUBLIC PAGES OR PORTAL, AND THE TOTAL LIABILITY OF KYROS TRIALS TO YOU WILL NOT EXCEED ONE HUNDRED US DOLLARS (US $100). THIS SECTION DOES NOT LIMIT LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR ANYTHING THAT CANNOT BE LIMITED BY LAW, AND DOES NOT APPLY TO ANY CLAIM RELATING TO YOUR PARTICIPATION IN A STUDY, WHICH IS GOVERNED BY YOUR INFORMED-CONSENT FORM AND THE RESEARCH SITE'S OBLIGATIONS.

11. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles, except where the law of your state of residence gives you protections that cannot be waived. We do not require arbitration and do not ask you to waive class actions.

12. Changes

We may update these Terms by posting a revised version with a new "Last updated" date. Material changes will not apply to a prescreen you have already submitted.

Reader guidance, separate from the document

This section explains how to review website use. It does not amend the policy or supply missing contract terms. Read the published document above and request the current full agreement where the page is a summary. Your organization should confirm that the wording addresses the intended use before relying on it.

Begin with a list of public resources, account access and participant-support boundaries. Identify who at the site owns each question and what evidence is needed. A general product description cannot answer every contractual or study-specific issue. Keep unanswered questions in the review record rather than treating silence as a favorable term.

Review the workflow and the evidence

The practical responsibility is using public information without treating it as clinical advice. Ask what record would show that the process was followed and who can review it. A demonstration with sample data can clarify the workflow without disclosing participant information. It does not replace your legal or operational assessment.

For electronic research records, inspect the responsible user, dates, status, record linkage and change history. For public website interactions, review the information requested and the stated purpose. These are different contexts; a business-contact form should not be used to submit source data or confidential study documents.

Keep access and communication specific

Use individual accounts and the access appropriate to the person’s role. A shared login prevents a reliable link between an action and its responsible user. When inviting a reviewer, check the study and access period rather than assuming that a broad organization role is necessary.

For a question about this document, contact legal@kyrostrials.com. For privacy rights or handling concerns, contact privacy@kyrostrials.com. For a technical barrier or service problem, contact support@kyrostrials.com. Include business contact details, the page and the question, but do not paste participant names, health information, credentials or signed study documents into ordinary email.

Plan review before sensitive use

Request the current security summary, provider information and relevant agreement status before transferring sensitive records. Public summaries do not establish BAA execution, a particular vendor arrangement, an uptime guarantee or a certification. If a requirement is unresolved, document it and obtain an answer instead of inferring readiness from a feature being visible.

Your site’s procedures should explain who approves the system’s intended use, how staff are trained and how exceptions are handled. Keep the review proportionate to the study and data involved. A software control supports the procedure; it does not replace investigator responsibility or participant-facing obligations.

Retain context when records move

Before importing or exporting study information, identify the original records, signature evidence and audit histories that must remain available. A spreadsheet can carry values and dates without reproducing the source system’s historical events. Keep source exports and reconcile sample records so a later reviewer can understand the transition.

Review the trust hub for related policies and summaries and the switching guide for a sample migration review plan. Contract-specific archive or exit terms need the full agreement. Customer data is not deleted for non-payment, but your organization still needs to plan record retention and access under the applicable research rules.
